Scope of This Policy

This privacy policy (this “Policy”) describes Trail’s End policies and practices for collecting and using personal information through our websites at www.trails-end.com and www.scouting.trails-end.com (the “Websites”) and the Trail’s End mobile application (the “App”) (collectively referred to as the “Site” or “Sites”). It does not apply to third-party platforms or to other platforms owned by Trail’s End or through other channels, such as over the phone or in person.

This Policy also contains Trail’s End practices for collecting information from minors under the age of thirteen (13), in compliance with the Children’s Online Privacy Protection Act.

Your Consent

Please take a few minutes to review this Policy before using our Site. By using our Site, you are consenting to the collection, use and disclosure of your information as set forth in this Policy. If you do not agree to be bound by this Policy, you may not access or use the Sites.

This Policy is part of the Terms of Use that govern your use of the Sites.

Types of Personal Information We Collect

Trail’s End collects and processes various types of information about you depending on your activities when using the Sites. Some of the information we collect may be “Personal Information”—information that identifies you personally, alone or in combination with other information available to us. Other information may be non-personally identifiable, such as information collected by cookies. Trail’s End will not collect Personal Information about you when you visit our Sites unless you choose to provide that information.

Information You Manually Provide . We collect the Personal Information you manually provide (e.g., using your keyboard, mouse, voice text or touchpad) when you use our Sites. For example, we collect the information you provide when you register for an account, interact with us through a third party platform, such as Facebook, place an order, subscribe to our email or SMS updates, or otherwise interact with our Site. Some of the information you manually provide may be Personal Information. For example, when you register for an account, we may ask you to provide your name, physical address, email address, home phone and/or mobile number, gender and date of birth. It may also connect you to other individuals on whom we collect information, such as linking a scout’s record to his or her parents’ records. We also collect other content you may send to us, such as images and videos. If you use our Site’s order forms, you will be asked to provide contact information such as name, email address, and shipping information, as well as financial information such as your credit card number and expiration date. Some features and services require additional Personal Information or demographic information. For example, when you enter contests you may be asked to provide your contact information so that we can reach you in the event you win a prize. Some of the information you post to this Site may constitute User-Generated Content. All User-Generated Content must comply with our Terms of Use.

Information From Your Browser or Device . We may collect information that is sent to us automatically by your web browser or mobile device. This information typically includes your IP address, the name of the operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. It may also include your location, where you may be registered to sell product, and location of sales you make through the App, and the products you are selling through the App, or manual sales you upload to the App. The information we receive may depend on your browser or device settings. You may choose to disable some of these settings. If you do so, some features of the App and the Services may be unavailable to you. The information we receive from your web browser and device may or may not be personally identifiable. However, we may combine it with other information in an attempt to identify you or we may combine in with information that does identify you. We may also use this information to help users locate a local council.

Free-Text Boxes . The information that you provide in each case will vary. In some cases, you may be able to provide Personal Information via email or free text boxes, such as contacting Trail’s End to request further information. When providing your Personal Information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers, credit card information or other sensitive personal data, unless required for our services.

Sync Contacts While using our App, you may have the option to sync your personal contact list from your mobile device, such as a scout or legal guardian providing phone contacts to use for the scout’s online page. When providing such information, you are solely responsible for obtaining the necessary consents and authorizations from any individuals in accordance with applicable data protection laws and regulations, and Trail’s End shall not be responsible or held liable for your failure to obtain the necessary consents. Once you have synced the contact list, we may disclose such information to our website and through our API hosted at apiv3.trails-end.com and/or trails-end.com.

Cookies and Similar Technologies

Our Sites use standard Internet “cookie” technology. A cookie is a bit of information that is stored on a visitor’s hard drive that allows a site to track how a visitor navigates through the Sites and areas in which a visitor shows interest. In general, we use cookies and other web technologies to:

· collect information about the ways visitors use our Sites—which pages they visit, which links they use, and how long they stay on each page;

· support the features and functionality of our Sites—for example, to save you the trouble of reentering information already in our database or to prompt the settings you established on previous visits; and

· personalize your experience when you use our Site.

We may use the following categories of cookies on our Sites.

  • Strictly Necessary Cookies. These cookies are essential in order to enable you to move around the Sites and use its features. Without these cookies, services you have requested, such as maintaining a record of your purchased items, cannot be provided.
  • Performance Cookies. These cookies collect anonymous information on how you use our Sites to help us understand how you arrive at our Sites, browse or use our Sites and highlight areas where we can improve, such as navigation.
  • Functionality Cookies. These cookies remember choices you make such as the country from which you visit our Sites, your preferred language, and your search parameters. This information can then be used to provide you with an experience more appropriate to your selections and to make your visits to our Sites more tailored to your preferences. The information in these cookies may be anonymized. These cookies cannot track your browsing activity on other websites.
  • Targeting Cookies or Advertising Cookies. These cookies collect information about your browsing habits in order to make advertising more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of an advertising campaign.

For example, we may use Google Analytics, a web analytics tool that helps us understand how visitors engage with our Sites. We also use Salesforce tools,Pendo, and Freshdesk for similar purposes. Other third parties may deliver cookies to your computer or mobile device for the purpose of tracking your online behaviors over time and across nonaffiliated websites and/or delivering targeted advertisements either on this Site or on other websites.

You have choices about the information third parties may collect about you through the site. The information we collect using cookies and similar technologies may or may not be personally identifiable, but we may link it to Personal Information that you provide. With most Internet browsers or other software, you can erase cookies from your computer hard drive, block all cookies, or receive a warning before a cookie is stored. Please refer to your browser instructions or help screen to learn more about these functions. Although you are not required to accept cookies when you visit our Sites, you may be unable to use all of the functionality of our Sites if your browser rejects our cookies.

User-Generated Content

The User-Generated Content you submit on or through our Sites may be available to others who visit our Sites. In addition, we may use User-Generated Content you submit on or through our Sites in advertising campaigns and other promotions. We may or may not use your name in connection with such use, and we may or may not seek your consent before using the content for such purposes.

Therefore, you should have no expectation of privacy with respect to User-Generated Content you submit on or through our Sites. You should not submit any content you do not wish to make available to the general public, and you must take special care to make sure your submissions comply with our Terms of Use. In particular, your submissions must not violate the privacy or rights of others. You may not use false identifying information or contact information, impersonate any person or entity, or otherwise mislead us as to the origin of any User-Generated Content.

How We Use Personal Information Collected Through This Site

Generally, we use the Personal Information we collect through our Sites:

  • to provide the information, products and services you request;
  • for security, credit or fraud prevention purposes;
  • to provide you with effective customer service;
  • to provide you with a personalized experience when you use our Sites;
  • to contact you with special offers and other information we believe will be of interest to you (in accordance with applicable law and any privacy preferences you have expressed to us);
  • to contact you with information and notices related to your use of our Site;
  • to invite you to participate in surveys and provide feedback to us (in accordance with any privacy preferences you have expressed to us);

  • to improve the content, functionality and usability of the Sites;

  • for any other purpose identified in an applicable privacy notice, click-through agreement or other agreement between you and us.

Duration. The length of time we intend to retain Personal Information, including sensitive information, if any, is for as long as reasonably necessary to carry out our intended business purpose for such information.

Use of Aggregated Information

We may use information gathered through our Sites to create a compiled, aggregate view of our Sites’ audiences and their visitors’ usage patterns. Aggregate information is not personally identifiable. We use aggregated information to operate our services and to better understand our audiences as we develop new products and services. We may also share aggregated information with our third-party service providers as well as with potential investors, advertisers, and subscribers so they can better understand and/or market to our audiences.

Use of Survey and Contest Information

From time to time, we may post a survey on our Sites or, if we have your contact information and your consent, we may send you a questionnaire or survey or information related to contests.

The requested information typically includes contact information, such as name and shipping address, and demographic information, such as zip code. Contact information will be used to notify the winners and award prizes. Survey information will be used to monitor or improve the use and satisfaction of our Sites and to compile statistical information. These statistics help us understand the needs and preferences of the groups we serve and improve the content and functionality of our Site.

Your Choices

In General. We respect your right to make choices about the ways we collect, use and disclose the information you provide on or through our Sites. In most cases, we will ask you to indicate your choices at the time we collect your Personal Information.

Previously Expressed Preferences. You may change previously expressed preferences regarding how we use your Personal Information. For example, if we provide subscription-based services, such as email newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed. Transactional or service-oriented messages, such as delivery confirmation messages, are usually excluded from such preferences, as such messages are required to respond to your requests or to provide goods and services, and are not intended for the purposes of marketing. If you have provided your contact information and receive periodic emails from us, you may be able to change preferences through an account you create on this Site, or by clicking the “Update Profile” or “Unsubscribe” link in an email’s footer.

Text Messaging. You may have the opportunity to receive SMS or "text" messages, pre-recorded voice messages or auto-dialed phone calls from us, our affiliates and related entities as well as third parties. Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested. In providing your mobile device number or cell phone number to us, you knowingly consent to such communications from us or for us to use your cell phone number or mobile device number in accordance with our Terms of Use. In providing your number, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to us, or from which you sent the text message request to us. You further acknowledge that no purchase is required to opt into this service, and you may opt-out of SMS texting at any time by replying to our text message as instructed. Otherwise, please contact us using the information provided below.

Do Not Track (“DNT”) Mechanisms. Because of the changing state of technology and indecision within the industry regarding the meaning of DNT signals, we currently do not make any guarantee that we will honor DNT signals.

How to Access, Update, or Correct Your Information

If you would like to access, update, or correct the information you provided to us, please sign into your account and go to “Account Info” or contact us at support@trails-end.com. We will respond to you within a reasonable time and, in any case, within the time limits established by applicable law. We may ask you for additional information to verify your identity. In most cases, we will provide access and correct or delete any inaccurate information you discover. In some cases, however, we may limit or deny your request if the law permits or requires us to do so or if we are unable to verify your identity.

Steps We Take to Safeguard Your Personal Information

In any organization, failure to protect Personal Information can increase the risk of a privacy breach. These privacy breaches can lead to things such as reputational harm, fraud or identity theft. We maintain reasonable administrative, physical and technological measures to protect the confidentiality and security of Personal Information you submit on or through this Site. For example, when collecting credit card information for online purchases, your credit card information is never stored on our servers, and instead it is transmitted through encrypted means to our PCI-DSS compliant vendor. Unfortunately, no website, server or database is completely secure or “hacker proof.” We therefore cannot guarantee that your Personal Information will not be disclosed, misused or lost by accident or by the unauthorized acts of others. Further, we cannot control dissemination of Personal Information contained in User-Generated Content you post on or through our Site, and you should have no expectation of privacy in such information.

How We Share Your Personal Information With Others

We do not sell or lease your Personal Information to any third party. We may disclose your Personal Information to a third party for a business purpose. We may disclose your Personal Information for a business purpose to the following categories of third parties:

Third–Party Service Providers . Trail’s End shares Personal Information collected through our Sites with third-party service providers who act for or on behalf of Trail’s End. For example, we may use third-party vendors to design, operate, and/or host our Site, to conduct surveys, to help us with our promotional efforts, to ship orders, and to bill users for good and services. These third parties may need information about you to perform their functions.

With Other Users of This Site. The User-Generated Content you submit on or through our Site may be available to others who visit our Site. Any Personal Information contained in User‑Generated Content you submit can be read, collected, or used by others, and could be used to send you unsolicited messages. In addition, we may use User‑Generated Content you submit on or through our Site in connection with our news gathering and reporting activities or for advertising campaigns and other promotions.

With Other Carefully Selected Business Partners . From time to time, we may share your Personal Information with selected third parties (other than our service providers). For example, we partner with third parties to sponsor contests or other promotions, and we may share with these third parties the Personal Information you submit to us to participate in the contest or take advantage of the promotion. Before doing so, however, we may offer you the opportunity to “opt out” or “opt in” as required by applicable law. In addition, Personal Information provided to us will also be made available to councils as needed to support and run the popcorn sales program.

With Our Licensors, Manufacturers and our Affiliates . We may share the information collected through the Sites with our affiliates, manufacturers and licensors (collectively “Other Parties”). Our Other Parties may use the information in all the ways listed in this Policy, provided that such use relates to services authorized by Trail’s End.

Within the Trail’s End Family of Businesses. We may share information collected through our Sites with other companies in the Trail’s End corporate structure, including affiliates, subsidiaries, parent companies, and sister companies existing now or hereafter acquired, however, we will not share such information with affiliates outside of Weaver Fundraising, LLC, d/b/a Trail’s End, for such affiliates to use in their own marketing.

Business Transfers . Your Personal Information may be transferred to a successor organization if, for example, we transfer the ownership or operation of the Sites to another organization, if we merge with or are acquired by another organization, or if we liquidate our assets. In negotiating with a third party about entering into such an arrangement, we may need to disclose your Personal Information. In such cases, we will take reasonable measures to protect the Personal Information we disclose. If such a transfer occurs, the successor organization’s use of your Personal Information will still be subject to this Policy and the privacy preferences you have expressed to us.

Compliance With Laws and Protection of Our Rights and the Rights of Others . We may disclose your Personal Information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your Personal Information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of the Sites; to enforce or apply our Terms of Use or other agreements; or to protect our own rights or property, or the rights, property or safety of our users or others.

With Third-Party Social Media Platforms. We may provide functionality on our Site that allows you to automatically post information to a third-party social media platform (such as Facebook, Twitter, or Pinterest). If you choose to take advantage of this functionality, people who can view your profile on the third-party platform will be able to see your post. Thus, you should have no expectation of privacy in those actions.

In Aggregate or De-Identified Form. We use information collected through our Site to create a compiled, aggregate view of usage patterns. We may share aggregate information with third parties, so we and they can better understand our user base. We may also share with third parties information about how particular individuals use our Sites, but only on a de-identified basis (“Individualized Data”). Individualized Data is not personally identifiable, but it does reflect the usage patterns of a particular Site user, as opposed to Site users collectively. We may provide basic demographic information (gender and age) in conjunction with providing Individualized Data. Third parties typically use this information for analytical purposes and to market their own products and services.

As Described in a Privacy Notice . We reserve the right to disclose your Personal Information as described in any privacy notice posted on a page of the Sites where you provide that information. By providing your Personal Information on that page you will be consenting to the disclosure of your Personal Information as described in that privacy notice.

As Described in a Click–Through Agreement . We reserve the right to disclose your Personal Information as described in any click–through agreement to which you have agreed.

Children’s Privacy

We adhere to the Children’s Online Privacy Protection Act (COPPA) and do not knowingly register or otherwise collect Personal Information through our Sites from any child under the age of 13 without the prior verifiable consent of the child’s parent or guardian. However, we are allowed to collect a child’s name for the one-time purpose of seeking verifiable parental consent at the request of the child under the age of 13. If verifiable consent is not provided within 14 days of the child providing the parent’s email address, we will delete the parent’s email address from our system. Once verifiable consent is obtained from a child’s parent or guardian, we collect only that Personal Information from such children that is relevant to their participation on our Sites, including a username, password, security questions for access to the account, home phone and/or mobile number, and Scouting Unit with which the child is associated. As noted above, we may collect and use coordinates ascertained through IP addresses in order to assist users in locating a local council. Children may, but are not required to, post videos, audio files, pictures, biographies, and other Personal Information to their fundraising page. We will provide appropriate notification and seek parental consent for these activities as required by law.

We do not sell or share information obtained from minors with any third parties for their own use. We do have third party partners who may have access to information we collect that is subject to the requirements of this section in order to assist us with or co-sponsor the Websites or mobile application fulfillments, such as for purposes of accepting and fulfilling orders or processing payments. We do not share a child’s information with blogs or other sites where the information would be publicly accessible, and no Personal Information collected from a child under the age of 13 may be made publicly available by that child other than a first name, last initial, and “favorite product.”

If we should inadvertently collect information from a child under the age of 13, we delete that information, except to the extent needed to seek verifiable parental consent from the minor’s parent or legal guardian. We protect the information we collect with security safeguards and confidentiality measures that are commensurate with the sensitivity of the information. Parents or legal guardians have the right to review their child’s Personal Information, delete it, or withdraw permission to allow further collection or use of that information by emailing us at support@trails-end.com. We will not require a child to disclose more information than is reasonably necessary to participate on our Site.

Links to Other Sites

Our Site may provide links to other websites operated by third parties. We expect our partners, providers of content and services, and advertisers to be transparent about their data protection practices. Be aware, however, that we have no control over third-party websites. This Policy does not apply to Personal Information collected on any third-party website. When you access third-party websites through a link on our Site, please take a few minutes to review the privacy policy posted on that site.

Location of Services

Our Sites are designed for use by individuals in the United States and Canada only. We do not warrant or represent that this Policy or the Sites’ use of your Personal Information complies with the laws of any other jurisdiction. Furthermore, to provide you with our services, we may store, process, and transmit information in the United States and other locations around the world, including countries that may not have the same privacy and security laws as yours. Regardless of the country in which such information is stored, we will process your Personal Information in accordance with this Policy.

Changes to the Privacy Policy

Trail’s End regularly reviews this Policy to ensure that it provides an appropriate level of protection for your Personal Information. If we make material changes, we will notify you by updating the Effective Date of the most recent revisions to this Policy on these pages. Please return to this Policy from time to time to make sure that you are current and up to date on this Policy, as your continued use of the Sites indicates your agreement to the revised terms. Any changes to this Policy will become effective immediately upon being posted as indicated by the Effective Date, unless we indicate otherwise.

Your California Privacy Rights

If you are a resident of California, you may have the right to learn additional information about your Personal Information collected through the Sites. We do not disclose your Personal Information to third parties for their direct marketing purposes.

If you are a California resident and under the age of 18, you may request that we remove or update content or information that you have posted to our Sites by contacting us below. We may still retain your information to resolve disputes or comply with legal requirements; in this case, your Personal Information will be blocked from use for any other purpose.
